It is Ordered that landlord-respondent's motion to vacate the stay is granted, unless tenant-appellant: 1- pays to the landlord $3,600 for use and occupancy for April, May and June 2011 on or before 24, 2011; 2- pays accruing use and occupancy to the landlord at the last agreed upon rent level on each subsequent rental due date, without prejudice; and 3- perfects his appeal by no later than the September 2011 term - the filing deadline is July 6, 2011. In the event of tenant-appellant's failure to comply with the foregoing conditions, landlord-respondent may move on five days' notice for an order vacating the stay.
