ORDER ON APPLICATION

Application by the appellant pursuant to 22 NYCRR 670.8(d)(2), in effect, to enlarge the time to pay the filing fee, to enlarge the time to serve and file his brief, to accept the brief for filing, and to deem the brief timely served on an appeal from an order the Supreme Court, Dutchess County, dated July 26, 2010.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted and, upon payment of the filing fee on or before July 7, 2011, the brief submitted to the Clerk of the Court will be accepted for filing and deemed timely served.
