Motion by assigned counsel, in effect, to be relieved of an assignment to prosecute an appeal from a judgment of the Supreme Court, Queens County, rendered May 29, 2009.

ORDERED that the motion is denied without prejudice to assigned counsel filing a brief pursuant to Anders v California (386 US 738), if she be so advised (see People v Belton, 74 AD3d 834).
