| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss appeals from a judgment of the Supreme Court, Westchester County, entered May 19, 2010, and an order of the same court dated December 23, 2010, on the ground that the appellant's appendix is inadequate, or alternatively, to enlarge the time to serve and file a brief and respondent's appendix, and to direct the appellant to pay for the costs of the preparation and filing of the respondent's appendix.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief and respondent's appendix is granted, the respondent's time to serve and file a brief and respondent's appendix is enlarged until July 22, 2011, and the respondent's brief and respondent's appendix must be served and filed on or before that date; and it is further,
ORDERED that the motion is otherwise denied.
