Now, upon reading and filing the affidavit of Alexis Oberlander sworn to May 25, 2011, the notice of motion with proof of service thereof, the affirmation of David E. Gann, Esq. dated June 3, 2011, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the stay granted by Justice Peradotto is extended on the condition that the appeal is perfected on or before August 19, 2011, and
It is further ORDERED that appellant perfect the appeal on or before August 19, 2011, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
