Respondent-appellant having moved for an extension of time to perfect the appeal taken herein from an order of the Family Court, Livingston County, entered in the Office of the Clerk of said Court on January 20, 2010,

Now, upon reading and filing the affidavit of Norman P. Effman, Esq., sworn to May 26, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and respondent-appellant shall file the original stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before August 22, 2011, and in the event of failure to so perfect the appeal is hereby dismissed without further order, and

It is further ORDERED, upon the Court's own motion, that Charles J. Greenberg, Esq., PO Box 102, Buffalo, New York 14207-0102, is substituted as counsel to conduct the above-entitled appeal, in place of Norman P. Effman, Esq., and

It is further ORDERED that the Clerk of the Family Court, Livingston County is hereby directed to provide Charles J. Greenberg, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings had and filed in said Clerk's Office upon which the appeal is based.
