| DECISION & ORDER ON MOTION |
Motion by the New York State Division of Human Rights for leave to reargue a proceeding pursuant to Executive Law § 298 to review a determination of the Commissioner of the New York State Division of Human Rights dated September 30, 2008, which was determined by decision and judgment of this Court dated December 14, 2010, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and judgment of this Court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, with $100 costs.
