| DECISION & ORDER ON MOTION |
Motion by the respondent to vacate the opinion and order of this Court dated October 26, 2010, which disbarred the respondent based on default. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on February 13, 2002. By decision and order on application of this Court dated February 1, 2010, inter alia, the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against the respondent based on a verified petition containing six charges of professional misconduct. By opinion and order of this Court dated October 26, 2010, the respondent was disbarred based on default and his name was struck from the roll of attorneys and counselors-at-law.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
