DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated September 17, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied with leave to renew upon submission of additional papers, including an affirmation from appellant's counsel detailing the status of the wrongful death compromise order submitted to the Surrogate's Court and the steps, if any, taken by appellant's counsel to facilitate obtaining such order.
