Motion by the appellant on an appeal from an order of the Supreme Court, Nassau County, entered November 12, 2008, to appoint the respondents' counsel as temporary administrator for the deceased respondent John Thomas Roesch.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied without prejudice to the appellant seeking appropriate relief in the Surrogate's Court or Supreme Court, Nassau County.
