DECISION & ORDER ON MOTION

Motion by the respondent for leave to file a supplemental record on an appeal from an order and judgment (one paper) of the Supreme Court, Nassau County, dated June 28, 2010, and to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to file a supplemental record is denied with leave to renew on or before July 15, 2011, upon submission of additional papers, including an affirmation from respondent's counsel identifying each document to be included in the supplemental record, and a showing that those documents are properly part of the record on appeal; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until August 1, 2011, and the respondent's brief must be served and filed on or before that date.
