Petitioner-respondent having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Jefferson County, entered in the Office of the Clerk of said Court on March 21, 2011,

Now, upon reading and filing the affidavit of John L. Curtis, sworn to June 9, 2011, the notice of motion with proof of service thereof, the affidavit of John L. Sabik, Esq., sworn to June 21, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the submission of a new motion that includes an affidavit that sets forth appellant's gross monthly household income from all sources, including the income, if any, of his wife, as well as his assets and financial obligations, and otherwise addresses the allegations contained in the affidavit of John L. Sabik, Esq., sworn to June 21, 2011.
