Motion by respondent for leave to reargue an appeal from an orders of the Civil Court of the City of New York, Kings County, entered January 23, 2009 and April 22, 2009 respectively, which were determined by decision and order of this court dated April 24, 2011, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court. Cross motion by appellant for sanctions and an award of attorney's fees.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
