Motion by appellant to vacate a decision and order of this court dated March 28, 2011, which granted a motion by respondents to dismiss an appeal from a judgment of the District Court of Nassau County, Third District, entered January 6, 2010, and for an enlargement of time to serve and file papers in opposition to respondents' motion to dismiss the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied (CPLR 5513 [a]; UDCA 1703 [b]; see Strober King Bldg. Supply Ctrs., Inc. v Merkley, 266 AD2d 203 [1999]; Coogan v Starr, 30 Misc 3d 143 [App Term, 9th & 10th Jud Dists 2011]).
