Motion by appellant to vacate a decision and order of this court dated March 28, 2011, which granted a motion by respondents to dismiss an appeal from a judgment of the District Court of Nassau County, Third District, entered January 6, 2010, and for an enlargement of time to serve and file papers in opposition to respondents' motion to dismiss the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
