DECISION & ORDER ON MOTION

Appeal from an order of the Civil Court of the City of New York, Kings County, entered February 8, 2011. The order granted plaintiff's motion for summary judgment and denied defendant's cross motion for summary judgment dismissing the complaint.
On the court's own motion, it is
ORDERED that so much of the appeal as is from the portion of the Civil Court's order entered February 8, 2011 that granted plaintiff's motion for summary judgment is dismissed on the ground that said portion of the order was superseded by an amended order of the Civil Court dated April 4, 2011, which, among other things, denied plaintiff's motion for summary judgment.
