Motion by appellant for leave to reargue its prior motion for a stay pending the determination of an appeal from an order of the District Court of Nassau County, First District, entered November 29, 2010 as amended December 3, 2010, which prior motion was determined by decision and order of this court dated April 12, 2011, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
