DECISION & ORDER ON MOTION

Paul Sayegh, Appellant, v Richard Firman and
Sheila Firman, Respondents.

Motion by appellant for an enlargement of time to perfect an appeal from orders of the Civil Court of the City of New York, Kings County, entered November 5, 2009 and April 28, 2010. Cross motion by respondents to dismiss the appeal for lack of prosecution.

Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is

ORDERED that the motion by appellant for an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by September 2, 2011; and it is further,

ORDERED that in the event the appeal is not perfected on or before September 2, 2011, the court, on its own motion, may dismiss the appeal, or respondents may move to dismiss the appeal on three days' notice, and may serve such application in person; and it is further,

ORDERED that the cross motion by respondents to dismiss the appeal is denied.
