Motion by landlord for, among other things, an extension of time to file a notice of appeal from an order of the Civil Court of the City of New York, Queens County, entered October 23, 2009.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as the motion was served on the "estate of Hilda Ziemba," which is not a legal entity capable of being served (see Grosso v Estate of Gerhenson, 33 AD3d 587 [2006]).
