Application by Phoenix Life Insurance Co. pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Nassau County, dated August 31, 2010, and an appeal and cross appeal from an order of the same court dated May 16, 2011.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application is granted and the time of Phoenix Life Insurance Co., to serve and file a brief is enlarged until September 8, 2011, and the brief of Phoenix Life Insurance Co., including the points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), must be served and filed on or before that date.
