Appellant having moved for permission to proceed as a poor person, permission to proceed anonymously, assignment of Mental Hygiene Legal Service as counsel, permission to receive a transcript without having to pay a fee, sealing of the records, and to expedite the appeal taken herein from the order of the Supreme Court entered in the Office of the Clerk of the County of Oneida on June 7, 2011,
Now, upon reading and filing the affirmation of Megan E. Dorr, Esq., dated June 17, 2011, the notice of motion with proof of service thereof, and the affirmation of Joel L. Marmelstein, Esq., dated June 23, 2011, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to expedite the appeal is dismissed a premature (see 22 NYCRR 1000.10 [d]), and
It is further ORDERED that the motion is otherwise granted, and Mental Hygiene Legal Service is hereby assigned as counsel for the purpose of this appeal, and
It is further ORDERED that the Clerk of the County of Oneida is hereby directed to provide Mental Hygiene Legal Service with a copy of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings had and filed in said Clerk's Office upon which the appeal is based.
