It is Ordered that defendant-appellant's motion for a stay of all proceedings, including the trial scheduled for August 23, 2011, pending the determination of the appeal is granted on condition that defendant-appellant perfects its appeal by the November 2011 term - the filing date is September 8, 2011. In the event of defendant-appellant's failure to comply with the foregoing conditions, the plaintiff may move on five days notice for an order vacating the stay.
