Application by defendant pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this court from an order of the Criminal Court of the City of New York, Kings County, rendered October 17, 2006, which has been referred to me for determination.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application is denied as defendant has been deported and is no longer subject to the jurisdiction of the court (see People v Diaz, 7 NY3d 831 [2006]; see also People v Mark, 8 NY3d 907 [2007]).
