Claimant having moved for an extension of time to perfect his appeal and defendant having cross-moved for an extension of time to perfect its cross appeal taken herein from a judgment of the Court of Claims entered in the Office of the Clerk of said court on October 4, 2010,

Now, upon reading and filing the affidavit of Ronald J. Wright, Esq., sworn to July 15, 2011, the affirmation of Robert M. Goldfarb, Esq., dated July 21, 2011, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that claimant's motion is granted and claimant shall perfect the appeal on or before September 19, 2011, and, in the event of failure to so perfect, claimant's appeal is hereby dismissed without further order, and

It is further ORDERED that defendant's cross motion is granted and defendant shall perfect its cross appeal on or before October 24, 2011, and, in the event of failure to so perfect, defendant's cross appeal is hereby dismissed without further order.
