It is Ordered that undertenant-appellant's motion to continue the stay is granted on condition that he: 1- perfects his appeal by no later than the December 2011 term - the filing deadline is October 11, 2011; 2- pays accruing use and occupancy to the landlord's attorney at the rate of $1,862.19, to be paid on or before the tenth day of each month. In the event of undertenant-appellant's failure to comply with the foregoing conditions, landlord-respondent may move on five days' notice for an order vacating the stay and dismissing the appeal.
