On the Court's own motion, it is
ORDERED that the order on application of this Court dated August 9, 2011, in the above-entitled matter, on an appeal from an order of the Supreme Court, Putnam County, dated June 10, 2010, is amended by deleting from the second paragraph thereof the words "no papers having been filed in opposition or in relation thereto" and substituting therefor the words "the papers filed in opposition thereto."
