Now, upon reading and filing the affidavit of Frank Garcia sworn to June 29, 2011, the notice of motion with proof of service thereof, the affirmation of Leslie E. Swift, Esq. dated August 11, 2011, and due deliberation having been had thereon,
It is hereby ORDERED that the portion of defendant's motion seeking permission to file a pro se supplemental brief in excess of the page limitation prescribed pursuant to 22 NYCRR 1000.4 (f)(3) is dismissed as premature, and
It is further ORDERED that the motion is otherwise denied.
