It is Ordered that landlord-respondent's motion is denied as moot and the parties are directed to this Court's July 27, 2011 order, which granted tenant's motion to enlarge the time to perfect his appeal relating to Index Number 69269/2007 to the November 2011 term - the filing deadline for appellant's brief is September 8, 2011, and the filing deadline for respondent's brief is October 4, 2011. In the event of tenant-appellant's failure to comply with the foregoing condition, landlord-respondent may move on five days notice for an order dismissing the appeal.
