| DECISION & ORDER ON MOTION |
Motion by Denise O'Rourke for leave to appeal to this Court from an order of the Supreme Court, Nassau County, dated May 25, 2011, and upon granting such leave, to stay a certain hearing on the issue of sanctions, costs and attorney's fees, pending hearing and determination of the appeal. Separate motion by Genevieve Lane LoPresti, inter alia, to clarify an order to show cause issued by a Justice of this Court dated June 20, 2011.
Upon the papers filed in support of the motion by Denise O'Rourke and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the motion by Genevieve Lane LoPresti and the papers filed in opposition thereto, it is
ORDERED that the motion by Denise O'Rourke is denied as academic in light of the order of the Supreme Court, Nassau County, dated August 8, 2011; and it is further,
ORDERED that on the Court's own motion, the appeal purportedly taken as of right is dismissed, without costs or disbursements; and its is further,
ORDERED that the motion by Genevieve Lane LoPresti is denied.
