Motion by appellant on an appeal from an order of the Justice Court, Town of Wallkill, Orange County, entered April 6, 2011, for an order compelling a return to the affidavit of errors and for an enlargement of time to perfect the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the court below shall, within 21 days of service of a copy of this order upon it by appellant, file with the clerk of this court the affidavit of errors and the court's return pursuant to CPL 460.10 (3) (d); and it is further,
ORDERED that appellant's brief shall be filed within 60 days of this decision and order.
