On the Court's own motion, it is
ORDERED that the decision and order on motion dated December 15, 2010, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the defendant pursuant to CPL 460.30 for an extension of time to take appeals from a judgment of the Supreme Court, Queens County, rendered January 4, 2010, a judgment of the same court rendered December 8, 2009, and an amended judgment of the same court also rendered December 8, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and the defendant's moving papers are deemed to constitute a timely notice of appeals.
