| DECISION & ORDER ON MOTION |
Motion by the appellant-respondent on an appeal and cross appeal from an order of the Supreme Court, Westchester County, dated December 1, 2011, inter alia, to dismiss the cross appeal on the ground that the respondent-appellant has failed to pay one-half the cost of printing the joint record on appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the cross appeal on the ground that the respondent-appellant has failed to pay one-half the cost of printing the joint record on appeal is denied on condition that on or before September 16, 2011, the respondent-appellant pay the sum of $1,902.42 to counsel for the appellant-respondent and file proof of payment with the Clerk of the Court; and it is further,
ORDERED that the motion is otherwise denied.
