| DECISION & ORDER ON MOTION Motion To Dismiss Appeal |
Motion by the respondent to dismiss appeals from an order of the Supreme Court, Westchester County, dated November 18, 2010, to strike the joint record on appeal on the ground that it is incomplete and inaccurate or to require the appellants to supplement the joint record, and to enlarge the time to serve and file a respondent's brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike the joint record is granted to the extent that on or before September 27, 2011, the appellants shall file a supplemental joint record containing the redacted affidavit of the defendants' expert sworn to on June 17, 2010, and that branch of the motion is otherwise denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a respondent's brief is granted and the respondent's brief shall be served and filed on or before October 27, 2011; and it is further,
ORDERED that the motion is otherwise denied.
