ORDERED that the decision and order on motion of this Court dated May 4, 2011, in the above-entitled action, on an appeal from a judgment of the County Court, Dutchess County, rendered December 13, 2010, is amended by deleting from the caption thereof Indictment Number "126/10," and substituting therefor Indictment Number "126/09."
