| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the Supreme Court, Kings County, rendered February 8, 2007, to extend the time to serve and file a supplemental brief raising the issue that pretrial dismissal of the two counts of the indictment of which he was convicted requires reversal of the judgment.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the appellant shall serve and file the supplemental brief on or before September 16, 2011; and it is further,
ORDERED that the respondent shall serve and file its supplemental respondent's brief, if any, on or before October 17, 2011.
