Appellant having moved for an order removing the appeal from this Court's day calendar for October 26, 2011, and allowing John A. Cirando, Esq. to perfect appellant's appeal taken from an order of the Supreme Court entered in the Office of the Clerk of the County of Oneida, on July 19, 2010,
Now, upon reading and filing the affidavit of John A. Cirando, Esq., sworn to August 10, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and the appeal is removed from this Court's day calendar for October 26, 2011, and
It is further ORDERED that the time to perfect the appeal is extended, and appellant shall perfect the appeal on or before December 9, 2011, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
