Now, upon reading and filing the affirmation of James F. Miller, Esq. dated August 15, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered May 17, 2011 is hereby amended by striking therefrom the date August 15, 2011 and inserting in place thereof the date December 12, 2011, and
It is further ORDERED that James F. Miller, Esq. is relieved of his assignment to represent appellant, and
It is further ORDERED that Leanne Lapp, Esq.

is substituted as assigned counsel to prosecute the above-entitled appeal taken from a judgment of the Ontario County Court rendered December 15, 2008, in place of James F.
