Defendant and Mental Hygiene Legal Service having moved for permission to proceed as a poor person, for leave to appeal to this Court pursuant to CPLR 330.20 (21) from an order of the Onondaga County Court dated July 18, 2011, and to consolidate the aforementioned appeal with the appeals from orders of the same court issued December 7, 2010, December 20, 2010, January 18, 2011, and June 15, 2011,
Now, upon reading and filing the affirmation of Sheila E. Shea, Esq., dated August 10, 2011, the affirmations of Nan B. Clingman, Esq., dated August 25, 2011, the notices of motion with proof of service thereof, and the affirmation of James P. Maxwell, Esq., dated August 23, 2011, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks permission to proceed as a poor person is granted, and
It is further ORDERED that the Clerk of the County of Onondaga is hereby directed to provide appellants with a stenographic copy of the minutes upon which the appeal is based, and
It is further ORDERED that the motion insofar as it seeks leave to appeal from the order dated July 18, 2011, is granted, and
It is further ORDERED that the motion insofar as it seeks to consolidate the appeals from orders issued December 7, 2010, December 20, 2010, January 18, 2011, June 15, 2011, and July 18, 2011, is denied.
