Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and the time to file and serve said brief is extended to October 24, 2011, provided, however, that if such is not filed by that date, the right to do so is deemed withdrawn. The motion is otherwise denied in all respects.
