Appellant having moved for reassignment of counsel on the appeal taken from judgment of the Ontario County Court, rendered May 1, 2009,

Now, upon reading and filing the affidavit of Isiah Williams sworn to August 25, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that Leanne Lapp, Esq. is relieved of her assignment to represent appellant; and

It is further ORDERED that Shirley Gorman, Esq. 12 East Bank Street, Brockport, New York 14420 is substituted as assigned counsel to conduct the above-entitled appeal from the judgment of the Ontario County Court rendered on May 1, 2009, in place of Leanne Lapp, Esq., and said appeal may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c) (1) and ten copies of appellant's brief reproduced pursuant to CPLR 5529; and

It is further ORDERED that the Clerk of the County of Ontario is directed to provide Shirley Gorman, Esq. with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based; and

It is further ORDERED that the ordering paragraph of the order of this Court entered August 24, 2011 is hereby amended by striking therefrom the date December 22, 2011 and inserting in place thereof the date February 22, 2012.

Memorandum: Defendant may file a pro se supplemental brief pursuant to 22 NYCRR 1000.3(f) to supplement the brief filed by appellate counsel or he may move to proceed pro se with his appeal.
