DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to perfect an appeal from a judgment of the Supreme Court, Kings County, dated April 1, 2011. Cross motion by the plaintiffs-respondents to dismiss the appeal for failure to perfect in accordance with a decision and order on motion of this Court dated June 27, 2011.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that the appellant's time to perfect the appeal is enlarged until November 28, 2011, and the appellant shall perfect the appeal on or before that date, and the motion is otherwise denied; and it is further,

ORDERED that the respondents shall serve and file their briefs, if any, on or before December 19, 2011; and it is further,

ORDERED that the appellant shall serve and file its reply brief, if any, on or before December 30, 2011; and it is further,

ORDERED that the cross motion is denied.
