DECISION & ORDER ON MOTION

Motion by the plaintiff to deem a notice of appeal from a judgment of the Supreme Court, Richmond County, rendered November 21, 2006, which was timely served by Andre Morrison, to be timely filed.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied with leave to Andre Morrison to renew his prior motion for leave to reargue his prior motion pursuant to CPL 460.30 for an extension of time to take an appeal.
