Motion by the respondent R & R United, Inc., to dismiss an appeal from an order of the Supreme Court, Queens County, entered November 24, 2010, insofar as asserted against it as untimely taken.

ORDERED that the motion is granted and the appeal insofar as asserted against the respondent R & R United, Inc., is dismissed, without costs or disbursements (see CPLR 5513[a]).
