Motion by appellant for a stay pending the determination of an appeal from a final judgment of the Justice Court of the Village of Goshen, Orange County, entered July 19, 2011.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renewal upon proper service, as service was directed to be upon respondent's counsel, not respondent; and it is further,

ORDERED that, upon such renewal, appellant shall set forth good cause for his failure to comply with the deposit requirement contained in the order to show cause dated August 30, 2011.
