Motion by respondent to dismiss an appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered October 19, 2010, and to vacate a stay granted by decision and order of this court dated April 5, 2011.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion seeking to vacate the stay granted by decision and order of this court dated April 5, 2011 is granted and the stay is vacated; and it is further,
ORDERED that the branch of the motion seeking to dismiss the appeal is denied.
