Motion by Kent V. Moston for leave to withdraw as counsel for Peter Cassaberry on an appeal from an order of the Family Court, Nassau County, dated April 20, 2011.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied as unnecessary as counsel's assignment to represent Peter Cassaberry does not continue on the appeal (see Family Ct Act § 1120; 22 NYCRR 671.10).
