In the Matter of Scott M. Nelson, etc., respondent,

v Pedro Hernandez, appellant.

(Docket No. O-20399/10)

DECISION & ORDER ON MOTION

Appeals by Pedro Hernandez from two orders of the Family Court, Queens County, dated April 29, 2011, and August 4, 2011, respectively.

Now, on the Court's own motion, it is

ORDERED that the appeal from the order dated April 29, 2011 (Appellate Division Docket No. 2011-08863), is dismissed, without costs or disbursements, as no appeal lies from an order entered upon the default of an appealing party (see CPLR 5511).

PRUDENTI, P.J., MASTRO, RIVERA, SKELOS and DILLON, JJ., concur.
