| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by Harvey Bayer for reinstatement as an attorney and counselor-at-law. Mr. Bayer was admitted to the bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on October 18, 1961. By order of this Court dated March 14, 1988, Mr. Bayer was suspended from the practice of law for a period of one year. Mr. Bayer was reinstated to the Bar by decision and order on motion of this Court dated March 29, 1990. By opinion and order of this Court dated May 12, 2003, Mr. Bayer was disbarred upon his resignation and his name was stricken from the roll of attorneys and counselors-at-law.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied.
We find that Mr. Bayer does not demonstrate the requisite fitness and character to practice law.
