It is Ordered that tenant-appellant's motion to enlarge the time to perfect the appeal is granted on condition that tenant-appellant: 1- perfects his appeal from the December 10, 2010 order by no later than the February 2012 term - the filing deadline is December 13, 2011; 2- continues to pay accruing use and occupancy at the rate of $496.79 per month, on each subsequent rental due date, without prejudice. In the event of tenant-appellant's failure to comply with the foregoing conditions, landlord-respondent may move on five days' notice for an order dismissing the appeal.
