ORDERED that the order on application of this Court dated September 27, 2011, in the above-entitled appeal is recalled and vacated and the following order on application is substituted therefor:

Application pursuant to 22 NYCRR 670.8(d)(2) to enlarge the respondent's time to serve and file a brief on an appeal from an order of the Supreme Court, Kings County, dated July 12, 2010, and to enlarge the appellant's time to serve and file a reply brief.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted and the respondent's time to serve and file a brief is enlarged until October 19, 2011, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the reply brief shall be served and filed on or before November 14, 2011.
