Motion by respondent to dismiss as untimely an appeal from an order of the District Court of Nassau County, First District, entered March 18, 2010. Cross motion by appellant to extend its time to file a notice of appeal or to deem the appeal timely filed.
Upon the papers filed in support of the motion and cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
